New York recently announced a new law requiring credit card surcharges to be displayed upfront.
Many kosher restaurants add a charge for consumers using a credit card – either as a percentage of the bill disclosed during the order or by surprise. Both practices are now prohibited, according to Governor Kathy Hochul.
The press release states the new law:
- Limits credit card surcharges to the amount charged to the business by the credit card company; and
- Requires businesses to post before checkout:
- the total price of an item or service inclusive of the credit card surcharge; or
- a two-tiered pricing option, which requires the credit card price to be posted alongside the cash price.
If a business doesn’t follow the law as of this week, you can file a claim for a refund of added fees.
It will be interesting to see how kosher restaurants handle staying compliant under the new law.
